    Default Selling a gun in NC

    Greetings all. I bought a gun in maryland where I am from, but I have been PCS'd to North Carolina with the military for about a year and a half. My taxes are still coming out in Maryland, but I have a NC ID card from the DMV and the military says North Carolina is where I am residing.

    NC is a face to face sale state correct? Can I sell a pistol to someone while I am here living in North Carolina under North Carolina transfer laws even though it was bought/registered in Maryland?

    You can sell your pistol FTF in NC so long as the buyer has a NC pistol permit (it's a permit that YOU keep). Then I would get as much information on the buyer as possible and a statement signed by him stating that he is not a felon (the permit should already tell you this but I did it just to make sure).

    Have fun in NC, that's where I was stationed for 5 years and it's a beautiful state. But I still think SC is better.:p

    Where are you stationed? Bragg?

    I always prepare an invoice which I ask a buyer to sign. PM me with your e-mail and I'll mail you a sample.
    Also, if I were to sell a gun FTF I would still prefer to do it at an FFL dealer's shop. They will charge the buyer a transfer fee ($20-30) most likely, but it gives you an extra level of protection.

    You would keep the original. In NC when you ask for a PP you normally ask for like 10 at a time, because for each pistol purchased you need a new permit. You keep the permit on file with you basically to cover your six.

    BTW, I'm so sorry to hear that you're at Bragg. That place sucks.;)

    Haha! You should be grateful, your barracks are like hotel rooms compared to ours, and we don't have an ice rink on base. You spoiled bastards.:p:D

    I believe that if the buyer has a valid NC concealed carry permit, that you do not need a pistol permit from him. Probably a good idea to make a copy of his concealed carry permit and refer to it in the bill of sale.

    Here is the relevent interpretation of NC law from the NC AG's office:

    Under North Carolina law, it is unlawful for any person, firm, or corporation to sell,
    give away, transfer, purchase, or receive, at any place in the state, any pistol, unless the purchaser or receiver has first obtained a license or permit to receive such a pistol by the sheriff of the county where the purchaser or receiver resides, or the purchaser or receiver possesses a valid North Carolina-issued concealed carry permit. This requirement to obtain a permit prior to the transfer of a pistol applies not only to a commercial transaction, typically at a sporting goods store, but also between private individuals or companies throughout North Carolina. N.C. Gen. Stat. 14-402(a)
