    Hey all

    So here's the scenario;

    Guy has an MP5 with a sear, and says it can't be divorced. When asked why, he said that there's no serial on the sear.

    So here's the question.

    If you destroy the MP5, can you not keep the sear, and/or use the HK94/MP5 as the serial#?

    It just makes no sense to me that it has a sear, with no number???? Thank you in advance!!!!!

    It’s a clip-on registered receiver, generally considered the least desirable transferable. No, you can’t separate the “sear” from the receiver (not really a sear at all). Now Trey and I need to get back to B&B business.

    Multiple gunsmiths registered hk94 receivers and left them 100% stock and made a custom sear/trip(at least at the receiver, they cut the barrels and welded the existing carrier to f/a or replaced it). In reality the conversion device itself really should have been registered. It sounds like this is the case with the gun in question. In these cases no you can't destroy the receiver and then use the sear by itself. The sear is considered married to the gun, you can't modify the gun to a dual push pin(that would make an existing MG a new MG) and you can't just modify a new full auto lower to fit the gun without the conversion sear. This is why you will see where smiths have moved the conversion devices to ambi lowers but generally not the burst ones.

    The only real examples I can think of where this can be done is with some vollmer guns. He took registered sears and installed them in guns he converted to dual push pin after 86. ATF decided that this was 2 machineguns but didn't go after the ones that were sold. In those cases you'd need to destroy the dual push pin host to divorce the registered sear from it. The atf tried to destroy the guns he still had but he beat it in court. Its the only time I know of the once a mg always a mg was beaten. The judge threw out the atfs argument and left him convert the guns back with a semi shelf.
