Does anyone have any official statement from the ATF regarding the legality of placing a SBR MP5K in a firing briefcase?

I have found so much misinformation on this subject when searching around the net and asking NFA dealers.

I believe it would be legal as well as most others.

However some say the MP5K would have to be registered as a AOW to do so. That said you cannot register the same item twice to make it a SBR and AOW.

I have even had some say the case would need to be a AOW. However this logic doesn't seem sound to me. When using the logic of other AOWs, such as a wallet gun, the wallet is not the registered item, the gun would be.

I tried to search the ATF database regarding this issue, but cant find anything.

Anyone have anything official?

I bet that if you do it when nobody is around and nobody sees you do it...it's perfectly legal.

You could always call the NFA branch of BATFE and pull someone away from approving forms to ask them. But sometimes, when nobody seems to really know the answer, it's better to ask for forgiveness than permission.

I don't have a copy of the regs to quote, but it is my understanding that either of these are legally sufficient:

Registered as an AOW
Registered as an SBR
Weapon itself is a registered machine gun or contains a registered full auto device like a sear or trigger pack.

You are correct, you don't register the briefcase.

It's always been that if its registered as either an AOW,SBR, or have a RR/Sear you're good to go. Shooting without either of the three and you're in a world of hurt if someone catches you.

Then again, stupidity works for some people. Look at Hillary. So long as there wasn't any illegal intent..... What ever that means.

If the MP5 is registered as an SBR, I don't see why one would need to register it as an AOW. If you remove the stock from an MP5K registered as an SBR, it doesn't become an AOW, it's still an SBR on paper.

I'm not sure on the legality of having a pistol in a brief case like that, that would be interesting. I wouldn't want to be a test case for that!

This was covered. As long as you still maintain the stock to be able to revert it back to SBR config, you can do whatever you want with it.

Yeah I'm simply worried over the SBR being able to fire inside a concealed container. By definition that is a AOW.

The issue is more from the being fired from a concealed container side than it is having the stock off.

I plan to retain the stock on the gun with the case I build. If legal

I think it's a lot closer to being the same thing, because a forward grip and no stock is an AOW, and the firing from a concealed system is an AOW.

The letter clarifying that an SBR can be set up "temporarily" in AOW configuration.

Either way, my read is that if it's an NFA registered SBR that goes into the briefcase, you are good to go.

You are good to go as long as the weapon being used is a lawfully registered and possessed NFA item. The more important issue at hand is shooting the thing. Do NOT try to shoot it all James Bond like by holding it off to the side of your body. The forces of physics will tend to rotate the system to the back and up, which will put your feet and legs in jeopardy...

Does anyone manufacture operational briefcases still? I see HK ones pop up from time to time for usually a pretty penny, but since they aren't registered items, there doesn't seem to be anything stopping a manufacturer from making them, right?

In our unit we had 3 different versions. Here you usually just see the normal shooting case where the trigger is in the handle. We had another one that fell apart (Zerfallkoffer) and there was one in the armory that was pretty dusty made out of leather where you could enter the back through a small opening. I only shot the two first. Never saw anyone using the last one since it was pretty ugly. We never used them on duty though. Usually had the PDW in a small backpack or an A3 in special hidden compartment on the roofliner of the cars that would flip down in the passenger area.
I now that my old unit has dozens laying around that they could destroy but the armorer saved them from the shredder. About time I fly back to Europe and visit them.
I regret that back in the late 90s and early 2000s we didn't have handy iphones to take pics of everything.

It strikes me that somebody could make a tidy pile if they came up with a fashion updated version of the thing instead of the ghastly Samsonite 70's look. Maybe brushed aluminum and carbon fiber?

Except who carries a brief case anymore, you'd have to fund a way to stick it in an iPad to not stick out like a sore thumb.

Rolling your own wouldn't be difficult.

Ill be in the neighborhood of $200 with this build. It will be aluminum. Buy a cheap mount to weld or bolt in the interior of the case. Drill a hole for the muzzle(Ill be throwing a cover of some sort over the hole, such as a business card holder). The tough part will be making a handle, which wont be too difficult. Ill be using rods and ball joints or possible a throttle cable to activate the trigger
